1. Acceptance of Terms

By accessing and using the Gabochie Design website and services ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. Additionally, when using the Service's services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Services Provided

Gabochie Design provides the following services:

• Construction Cost Calculator: An online tool that estimates building costs based on user-provided specifications including bedroom count, location, floor size, and finishing preferences.
• 3D Rendering Services: Photorealistic visualization of architectural designs.
• Project Management: Oversight and coordination of construction projects.
• AI Consultation: AI-powered assistance for design and construction questions.
• Architectural and Interior Design: Professional design services for residential properties.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

To access certain features of our Service, you may be required to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

4. Payment Terms

For paid services:

• All fees are quoted in Ghana Cedis (GHS) unless otherwise stated
• Payment is required in advance unless credit terms have been agreed upon
• For one-time services, full payment is due upon confirmation of service
• For subscription services, billing occurs on a recurring basis
• All payments are processed through secure third-party payment processors
• Prices are subject to change with reasonable notice

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Gabochie Design Studio and its licensors. The Service is protected by copyright, trademark, and other laws of both Ghana and foreign countries.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent, except as expressly permitted in these Terms.

6. Limitation of Liability

In no event shall Gabochie Design, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

Cost estimates provided by our calculator are for reference purposes only and should not be treated as final quotes. Actual construction costs may vary based on numerous factors including market conditions, contractor pricing, and specific site requirements.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Provisions that, by their nature, should survive termination shall survive termination, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising under these Terms shall be resolved through binding arbitration in Accra, Ghana, in accordance with the rules of the Ghana Arbitration Centre.
